General Terms & Conditions

This website (the “CityXplora Platform”) is provided by iVenture Card International Pty Ltd, ABN 47 148 173 719, Level 14, 275 Alfred Street, North Sydney NSW 2060, Australia (“iVenture”).

These terms and conditions (“Terms”) of purchase are presented by iVenture, the operator of CityXplora Platform. “You” and “your” when used herein means any person who accesses the CityXplora Platform and persons who make use of the services.

iVenture reserves the right, at its sole discretion, to change or modify any part of the Terms at any time and without any notice. It is your obligation to regularly check the Terms to understand if any changes have been made. Continued use of the CityXplora Platform constitutes your acceptance of any revised or modified Terms.

The CityXplora Platform makes available for purchase certain tours, activities and other related services (each an Experience) which offered and promoted through the CityXplora website by the relevant operator of the Experience (each an “Operator”). The terms and conditions of each Experience provided via the CityXplora Platform vary by destination and are governed by Operator of the Experience. 

 

iVenture has made reasonable efforts to detail all relevant terms and conditions related to an Experience as provided by the Operator of such Experience.  iVenture makes no representations or warranties regarding the accuracy of descriptions on the services provided, or regarding suggestions or recommendations of the services offered or purchased through the CityXplora Platform.

This CityXplora Platform, the domain name, subdomains, any features or content or applications are all owned and operated by iVenture. All materials displayed including (but not limited to) data, audio, video, images, text, graphics or other material are protected by copyright and intellectual property rights. Using the CityXplora Platform means you have acknowledged that you shall not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, license, sell or otherwise exploit the CityXplora Platform without the express written consent of iVenture.

iVenture is not liable for any of the information, content or materials in respect of Operators and iVenture is in no way liable for any errors or omissions or losses or damages of any kind incurred in connection with the use or exposure to the Operators or their content.

You will indemnify and hold iVenture and its affiliates, officers, directors and employees harmless from, including but not limited to all damages, liabilities, settlements, costs and attorneys’ fees claims and demands made by any third party due to your access to the CityXplora Platform, your violation of the Terms, or infringement or other right of any person by you or any third party using your login details. To the fullest extent permissible by applicable law, iVenture’s liability, and the liability of its affiliates, officers, directors and employees liability to you or any third party in any circumstance arising out of or in connection with the CityXplora Platform is limited to the greater of (a) the amount of your transaction giving rise to the liability or (b) AUD$500.00 for any and all claims.

You acknowledge that iVenture has no liability and no duty to take any action regarding what content or services you gain access to, what effects the content or services have on you, how you may interpret or use the content and services, or what actions you may take afterwards, all in relation to your use of the CityXplora Platform.

While using the CityXplora Platform, you may be required to provide information including personal information, including via bookings, chatbox or other. By posting information on the CityXplora Platform or otherwise posting information or communicating via the chatbox, you:

  1. acknowledge that iVenture and the Operators have full rights to use and exploit such information subject and in accordance with all applicable laws
  2. authorise iVenture to use your personal data in accordance with its Privacy Policy.

Upon purchase of any Experience presented on the Cityxplora Platform you will be issued with a voucher (Voucher) which may enable the Voucher holder to obtain the applicable Experience when the Voucher is presented to the applicable Operator as detailed on the Voucher.

Upon purchase you will receive a payment receipt. Please allow up to 48 hours in the event a manual review process must be completed.

By purchasing an Experience offered by Operators you agree to be bound by the following:

  1. All Experiences are sold subject to availability at the time of purchase, unless otherwise specified in the fine print.
  2. All Experiences requiring pre booking are to be booked directly with the applicable Operator and are subject to that Operator’s booking instructions and terms
  3. All sales are final. Refunds will not be provided for any unused or unredeemed Vouchers;
  1. Access to any Experience purchased through the CityExplora Platform is subject to the specific terms and conditions established by the Operator which is supplying the Experience,
  2. To the extent permitted by law, iVenture disclaims all liability arising out of or consequent to your use of the Experiences.
  3. All responsibility for the conduct, quality, availability or other thing in respect of the use of any Experience is solely borne by the relevant Operator;
  4. iVenture limits our liability or warranties implied by statute or otherwise by resupplying the relevant services.

 

GENERAL TERMS & CONDITIONS REGARDING REFUNDS

Refunds are at the discretion of iVenture and may be granted under the following circumstances:

Notwithstanding your rights under any local laws, refunds cannot be given for any of the following reasons:

You are advised to consider all information provided on the CityXplora Platform, including the FAQs, and Fees and Charges, before purchasing.

Provided you are entitled to the refund with all necessary documentation, iVenture will process the refund within thirty (30) business days from receiving the refund request into the same credit card and in the same currency, the purchase was made.

Where a refund is granted, all pending bookings and/or passes will be cancelled.

iVenture does not take any responsibility for any bank charges or exchange rate fluctuations by the issuing bank.
